Sturgeon Falls Trespass Alleged that Canada failed to prevent the destruction of portions of the lower Sturgeon Falls in 1927 which resulted in loss and damage of Seine River IR# 23. Canada is in breach of its fiduciary trust, constitutional and statutory duties based on Treaty 3, the Indian Act R.S.C., 1886, as amended, and the Constitution Act, 1982, to protect Seine River IR# 23 from unlawful trespass, use, occupation, damage or alienation.
